IH News: Deepening Cross-Border Dialogue with Guang Dong Meng Hai Law Firm (Shenzhen)

To promote in-depth exchange between Mainland China and Hong Kong’s family law communities and address practical challenges in cross-border matrimonial disputes, GuangDong Menghai Law Firm[1] hosted a special seminar titled “Practical Operations in Hong Kong and Cross-Border Matrimonial Legal Affairs” on 10 October 2025, in Shenzhen. The event invited legal professionals from the firm to engage in an in-depth discussion centered on three core topics: “Divorce Proceedings,” “Asset Division,” and “Child Arrangements.” By exploring the differences and intersections between the two jurisdictions’ legal systems, the seminar served as a professional platform fostering dialogue and collaboration for legal practitioners across the Greater Bay Area.

In line with this commitment, our firm’s partners, 葉永青 [2]and 梁安澄 [3]and Ms Vivien Leung[4] from Denis Chang’s Chamber were honoured to participate in a recent professional seminar in Shenzhen conducted by GuangDong Menghai Law Firm.


The session first started with sharing from each party, followed with Q&A, and wrapped with an open discussion. During the session, we delved into the differences between the two lands for a range of aspects. From determining which jurisdiction to initiate a divorce, to the typical practice for custody arrangement.


During the seminar, our speakers shared practical insights into Hong Kong’s matrimonial law framework and offered expert perspectives on the following key issues:

  • Jurisdiction and Choice of Divorce Forum: Lawyers from both jurisdictions discussed critical factors in determining whether a cross-border couple should file for divorce in Mainland China or Hong Kong, helping clients identify the most advantageous forum.
  • Division of Assets: Addressing common challenges such as corporate equity, overseas real estate, trust structures, and financial instruments in cross-border divorces, the speakers outlined Hong Kong courts’ guiding in distributing matrimonial assets.
  • Child Arrangements: On sensitive matters including custody, care and control, and access, the panel explored differing judicial approaches taken by Mainland and Hong Kong courts under the “best interests of the child” principle. Practical solutions were discussed for resolving cross-border visitation and relocation applications through negotiation or litigation.


The seminar was very insightful in which both parties shared practical strategies for navigating the often-contentious areas of law, bridging the procedural and substantive gaps between the two legal systems.The dialogue underscored the pressing need for continued collaboration and knowledge-sharing among legal practitioners in the Greater Bay Area to better serve clients with cross-border needs.


搭建跨境法律桥梁,共话婚姻家事实务—梦海律所举办“香港及跨境婚姻法律事务”专题分享会

为促进内地与香港婚姻家事法律界的深度交流,了解跨境婚姻纠纷中的实务难题,梦海律师事务所于2025年10月10日在深圳举办了“香港及跨境婚姻法律事务实务操作”专题分享座谈会。本次活动特邀来自本所的团队,围绕“离婚主案”、“财产分配”、“子女安排”三大核心议题,深入探讨两地法律制度的差异与衔接,为大湾区法律从业者搭建起一座专业沟通的桥梁。

此次,本所律师行创始合伙人叶永青律师、合伙人梁安澄律师,以及大律师梁婉雯女士荣幸获邀担任主讲嘉宾,与梦海律所的律师团队及深圳本地法律同行展开深入交流与专业分享。


在本次研讨会上,本所介绍了香港婚姻法领域的实践,并就以下议题提供了专业见解:

  • 司法管辖权与离婚路径选择:两地律师重点探讨“跨境夫妻应选择内地还是香港起诉离婚”的关键考量因素,帮助当事人选择最有利的司法管辖区。
  • 复杂资产的处理与分割:针对跨境离婚中常见的公司股权、境外不动产、信托安排及金融资产等复杂财产,嘉宾分享了香港法院在评估与分割此类资产时的裁判原则与实操策略。
  • 子女安排:围绕子女抚养权、管养权及探视权等敏感议题,探讨了两地法院在“儿童最佳利益”原则下的不同适用标准,以及如何通过协商或诉讼妥善解决跨境探视、搬迁申请等。


本次座谈会不仅为内地与香港法律专业人士提供了宝贵的交流平台,更通过实务经验的分享,弥合了两地在诉讼程序、证据规则及实体法适用上的差异。与会者普遍认为,随着粤港澳大湾区人员流动日益频繁,跨境婚姻家事案件的数量持续上升,法律服务的需求也日趋复杂多元。

此次对话充分彰显了大湾区法律从业者加强合作、深化知识共享的必要性。唯有通过持续的交流与协作,才能为具有跨境背景的家庭提供更加全面、高效、人性化的法律服务,真正实现法律服务的“软联通”。
