Q1: What are the legal grounds for divorce in Hong Kong?

The sole ground for divorce is that your marriage has broken down irretrievably. This is established by proving one of five “facts” under the Matrimonial Causes Ordinance (Cap.179):

  1. Adultery: Your spouse committed adultery, and you find it intolerable to live with them.
  • Unreasonable Behaviour: Your spouse has behaved in such a way that you cannot reasonably be expected to live with them. This covers a wide range of conduct, from verbal abuse to financial control.
  • One Year’s Separation with Consent: You have lived apart for at least one year, and your spouse agrees to the divorce.
  • Two Years’ Separation without Consent: You have lived apart for at least two years. Your spouse’s consent is not required.
  • Desertion: Your spouse has deserted you for a continuous period of at least one year.

Q2: How long do I have to be married before I can file for divorce?

You cannot file for divorce within the first year of marriage, with very limited exceptions.

Q3: I didn’t get married in Hong Kong, can I file a divorce here?

You can file for divorce in Hong Kong provided you meet one of the Court’s jurisdictional requirements. According to Section 3 of the Matrimonial Causes Ordinance (Cap. 179), at least one of the following conditions must be met on the date of filing:

  • Either party is domiciled in Hong Kong;
  • Either party has been habitually resident in Hong Kong for a continuous period of at least three years immediately preceding the petition date; or
  • Either party has a “substantial connection” with Hong Kong.

Q4: How long does the divorce process usually take in Hong Kong?

An uncontested divorce with full agreement on all major issues typically takes 6 to 9 months.

In reality, however, many divorces are prolonged due to disagreements involving child custody, asset valuation, or disclosure disputes. It is common for these proceedings to last over a year, or even several years. Early communication and negotiation through mediation can significantly shorten the process and reduce costs for all parties involved.
